TRAFFIC AND MOTOR VEHICLES

 

ARTICLE 1. GENERAL

 

SEC. 20-1 BUSINESS SECTION DEFINED:

The business section of this town consists of all areas located within the Commercial District as depicted by the Town of Fort Kent zoning ordinance. (Amd. 12-09-96)

 

ARTICLE II. OPERATION

 

SEC. 20-16 SPEED LIMITS:

The speed on all town roads shall be as determined by the State of Maine, according to Title 29A MRSA, sections 2073, 2074, and 2075. (Amd. 12-09-96)

 

SEC. 20 17 U-TURNS:

It shall be unlawful for the driver of any vehicle to make a U-turn within the business section of this town. (Amd. 11-20-46)

 

SEC. 20-18 STOPPING ON TRAVELED PORTION OF HIGHWAY PROHIBITED:

Except when necessary in obedience of traffic regulations, signs or signals, it shall be unlawful for any motor vehicle (commercial as well) to come to a complete stop and remain stopped for any length of time upon the traveled portions of any street, road, or way within the limits of this town. SEC. 20-19 OPERATION OF SNOWMOBILES:

Operation of snowmobiles shall be as determined by the State of Maine, according to MRSA Title 12, except as outlined in Sec 20-21. (Amd. 05-08-00)

 

SEC. 20-20 OPERATION OF ALL-TERRAIN VEHICLES:

Operation of all terrain vehicles shall be as determined by the State of Maine, according to MRSA Title 12 and Title 29, except as outlined in Sec. 20-21. (Amd. 05-08-00)

 

SEC. 20-21 ST. JOHN VALLEY HERITAGE TRAIL:

This trail is to be used for recreation only; except for administrative purposes, no motorized vheicles are permitted on same except ATVs and snowmobiles as defined per Title 12 MRSA 7854 and Title 12 MRSA 7821. (Amd. 06-26-00)

 

All ATVs and snowmobiles using this trail must be registered and must display their numbers clearly.

 

Noise levels of the snowmobiles using this trail must be kept under 78 decibels at 50 feet, and 82 decibels at 50 feet for ATVs.

 

Speed of ATVs and snowmobiles must not eceed 15 MPH unless posted otherwise. The Cheif of Police, in consultation with the Trail Committee is responsible for posting speed limits

 

All motorized vehicles must yield the right of way to all non-motorized trail users.

 

All trail users must stop at all public road crossings.

 

All trail users must obey and comply with all properly posted signs along said trail.

 

Fines/penalties for violation of the above ordinance will be as follows:

 

            1st offense             $ 50.00

            2nd offense             100.00

            3rd offense             250.00

            Susequent offenses      250.00

 

Registered owners of ATVs, and snowmobilies as well as the operator of same are subject to the above fines for violation of any provisions of this ordinance.

 

Maine District Court, Division of Western Aroostook, shall have exclusive jurisdication for enforcement of this ordinance.

 

Fines/penalties collected by the Court shall be payable to the Town of Fort Kent.

ARTICLE III. STOPPING, STANDING, AND PARKING

 

SEC. 20-31 PARKING AREAS:

All motor vehicles or other vehicles shall park only in marked areas on East Main, West Main, Market, Hall and Elm Streets. Parking in these areas shall be limited to parallel parking only. (With the exception of the area located on the north side of Elm Street, specifically lots 63, 64, and 146 where angle parking is allowed).

 

Parking shall be limited to a two (2) hour period between the hours of 8:30 am and 9:30 p.m. in all areas except for the entire length of East Main Street and the section of West Main Street from the intersection of Monument Square to the intersection of East Main Street.

 

There will be no parking on any other street, road or way in the Town of Fort Kent, or on any unmarked sections of the abovementioned streets. (Amd. 05-08-00)

 

SEC. 20-32 PARKING NEAR HYDRANT PROHIBITED:

The parking of motor vehicles or other vehicles within the limits of this town so that any part of such vehicle is within eight (8) feet of any fire hydrant is hereby forbidden. (Amd. 09-02-85)

 

SEC. 20-33 PARKING OF TRUCKS PROHIBITED:

It shall be unlawful for any vehicle registered with the Secretary of State for a capacity of one and one-half (1-1/2) tons or more to park in areas marked or designated in section 20-31. (Amd. 09-02-85)

 

SEC. 20-34 PARKING ON LEFT PROHIBITED:

It shall be unlawful to park or attempt to park any vehicle facing traffic upon the left hand side of any street, road, or way within the limits of this town. (Amd. 09-02-85)

 

SEC. 20-35 PARKING DURING WINTER SEASON:

It shall be unlawful to park any vehicle upon or along the side of the streets, roads, or ways within the limits of the Town of Fort Kent between the hours of 1:00 am and 6:00 am from the fifteenth (15) day of November to the fifteenth (15) day of April. The purpose of this section is to clear the roadways in order to allow winter snow removal. Vehicles will be towed at the owner’s expense. (Amd. 09-02-85)

 

SEC. 20-36 PARKING DURING SUMMER SEASON:

It shall be unlawful to park any vehicle upon or along the side of East and West Main Streets in the Town of Fort Kent between the hours of 3:30 am and 6:00 am from the fifteenth (15) day of April to the fifteenth (15) day of November. The purpose of this section is to clear the roadways in order to allow for street sweeping operations. Vehicles will be towed at the owner’s expense. (Amd. 12-09-96)

 

SEC. 20-37 PARKING ON SIDEWALKS:

It shall be unlawful for any vehicle to park upon the sidewalks at any time. (Amd. 09-02-85)

 

SEC. 20-38 PARKING IN PRIVATE WAYS:

It shall be unlawful for the operator of any type vehicle to park or leave standing any such vehicle in driveways, roads, walks, lanes, or any private property that is marked with no parking signs. To do so will constitute a trespass and the offender will be subject to the general penalty provisions of the town ordinances as well as state law. Vehicles will be towed at the owner’s expense.

 

Owners of said property are to post their property and inform the Fort Kent Police Department of said posting, in writing, as well as sign an agreement to indemnify and hold harmless the Town of Fort Kent for any liability they may incur as the result of causing the removal of the vehicles from their property. SEC. 20-39 HANDICAPPED PARKING:

It shall be unlawful to park any vehicle in any parking area designated for handicapped parking in the Town of Fort Kent, unless legally permitted to do so.

 

Owners of private property with designated handicapped parking areas shall notify the Fort Kent Police Department in writing as to their desire to have the designated parking restrictions enforced. (Amd. 12-09-96)

 

 

 

SEC. 20-40 STOP SIGNS

SEC. 20-42 FINES AND OR PENALTIES:

 

A.                 Parking Ordinances.

 

1.                  It is hereby provided that any motor vehicle parked in violation of the foregoing sections shall be prima facie evidence of unlawful parking by the person or entity in whose name to whom said vehicle is registered.

 

2.                  The officer citing the vehicle shall notify the owner by placing a ticket properly identifying the violation, the license number of the motor vehicle, and the time of the violation with said officers signature, and place same under the windshield wiper of said vehicle on the driver’s side.

 

3.                  Any person or entity who violates the parking ordinance shall be deemed to have committed a traffic infraction.

 

4.                  If, within seventy-two (72) hours of time of notification the owner or operator or any person fails to waive all court action by paying ten dollars ($10.00) for each violation to the Treasurer of the Town of Fort Kent, a summons will be issued ordering the said person or entity to appear in District Court to answer to the violation. 5.                  Upon finding that this Ordinance has been violated, the District Court shall impose a fine not to exceed one hundred dollars ($100.00) for each violation.

 

6.                  In the event said person or entity which is summoned to court fails to appear, they shall be found in default by said Court and a warrant shall be issued for their failure to appear by said District Court Judge.

 

7.                  See section 20-21 for fines/penalties at it pertains to the St. John Valley Heritage Trail.

 

 

B.                 Other Ordinance.

 

The District Court shall utilize the Maine State motor vehicle laws to impose fines and or penalties for any violation of local ordinances, excepting parking violations.

ARTICLE IV. CROSSWALKS AND SAFETY ZONES

 

SEC. 20-56 USE OF CROSSWALKS:

Pedestrians shall keep within a crosswalk while crossing a public way within the business section. (Amd. 11-20-46)

 

 

SEC. 20-57 CROSSING STREETS OTHER THAN AT CROSSWALKS:

Pedestrians crossing all public ways where no crosswalk is provided shall cross at right angles to the curb and when not using a crosswalk shall yield the right of way to all vehicles.

SEC. 20-58 CROSSWALKS ESTABLISHED:

In order to provide for the safety of pedestrians in crossing the main traveled streets and public highways of this town, it is hereby enacted that the town officials shall establish certain crosswalks within this town and further that said officials shall designate the location of said crosswalks by painting or otherwise appropriately marking the streets or public highways where said crosswalks are so established. These certain crosswalks are to be established as four-foot ways across the streets or public highways, at the following locations:

ARTICLE V. BICYCLES

 

SEC. 20-71 BICYCLES TO BE REGISTERED:

It shall be unlawful for any person to operate or use a bicycle upon any street, alleyway or public highway within the limits of the Town of Fort Kent without first registering the bicycle with the Police Department and obtaining a license for the use and operation of said bicycle. The registration and license fee for each and every bicycle so operated and used in the Town of Fort Kent will be two dollars ($2.00) per year and each registration and license will be made to expire on the first day of January of the ensuing year. SEC. 20-72 POLICE DEPARTMENT TO PROVIDE TAGS AND MAINTAIN RECORDS:

The Police Department will designate and provide tags for the use of each bicycle and will establish the manner of displaying said tags. It is further provided that the Police Department will keep and maintain a record of all bicycles so registered. (Amd. 11-20-46)

 

SEC. 20-73 SUSPENSION OF REGISTRATION:

It is provided that the bicycle registration and license of any person may be suspended by the Police Department for a period not to exceed thirty (30) days when it is reported to the Police Department that such person, his agent or any person permitted to use the registered bicycle violated the provisions of any regulation to town ordinance pertaining to the use and operation of bicycles. SEC. 20-74 OPERATION OF BICYCLE

Operation of bicycles shall be as determined by the State of Maine, according to MRSA Title 29A, unless otherwise superseded by this ordinance. (Amd. 12-09-96)

 

SEC. 20-75 BICYCLES OPERATED ON SIDEWALKS:

No bicycle shall at any time be used or operated upon the sidewalks, pathways or other ways commonly provided for pedestrians within the limits of this town unless such use and operation consists only of pushing said bicycle while the user or operator is walking along the side of said bicycle. (Amd. 11-20-46)

 

SEC. 20-76 LIGHTS OR REFLECTORS TO BE PROVIDED AT NIGHT:

Any bicycle used or operated during the nighttime shall be equipped with a light or reflector on the rear and front of said bicycle; in the event reflectors are used it is provided that the rear reflector shall be red and the front reflector shall be white and each reflector shall be visible from a distance of not less than two hundred (200) feet. SEC. 20-77 PARKING BICYCLES IN FRONT OF BUSINESS ESTABLISHMENTS PROHIBITED:

No person shall park or cause to be parked any bicycles upon sidewalks of this town in front of store, offices, garages, gas stations or other business establishments. (Amd. 11-20-46)
